Illegal Investigation against Muslims in Japan
and Leakage of Sensitive Information:
Legal Action against National and Tokyo Metropolitan Government
Tokyo, May 16, 2011 – Today, the victims of the illegal investigation by the Metropolitan Police Department brought a lawsuit for damages against National and Tokyo Metropolitan Governments.
LEAKAGE – October 2010, 114 documents of illegal terrorism investigation against Muslims were leaked through the internet from Metropolitan Police Department’s public security division. These documents contain highly sensitive personal information including religious activities of Muslims in Japan. They also include details of methods and result of terrorism investigation.
ILLEGAL INVESTIGATION – The documents revealed security police’s illegal investigation practice. They showed that the security police systematically have collected personal information of many Muslims in Japan, that the police has watched Mosques and Muslim communities, and that the division illegally arrested some Muslims for the purpose of terrorism investigation by making up minor charges.
Plaintiffs: 14 Muslims living in Japan
Defendants: a. National Government (for National Police Agency and National Public Security Commission)
b. Tokyo Metropolitan Government (for Metropolitan Police Department)
Court: Tokyo District Court
Cause of Action: State Redress Act art.1, sec.1
Seeking damages for following illegal conducts : the defendants
a) Collection of personal information in a manner violating plaintiffs’ constitutional right for privacy and freedom of religion.
b) Storage of such information without reasonable cause.
c) Leakage of documents containing such information.
d) Failure to take measures to protect victims of such leakage.
Damages: 11 million JPY for each plaintiff (Total: 154 million JPY)
